Experienced Mediator Simeon H. Baum (www.mediators.com), Best Lawyers’ 2011 and 2014 Lawyer of the Year for ADR in New York, will provide guidance on maximizing use of the mediation process and obtaining the greatest value for your clients. To enhance the representative’s effectiveness, one must understand the mediation process – a facilitated negotiation – and the mediator’s role. Following an overview of process, role and mediator selection, Mr. Baum will give tips on negotiation strategy and style, preparation for mediation, effective openings, information gathering and disclosure strategy, risk and transaction cost analysis, reality testing, commitment level and flexibility.
PRESENTER: Simeon H. Baum, Esq., litigator, and President of Resolve Mediation Services, Inc. (www.mediators.com) has been active as a neutral—mediator, arbitrator and evaluator—in over 1,000 disputes since 1992. For two decades, he has played a leadership role in the Bar relating to ADR. He was Chair of the FBA’s ADR Section, past President of the FBA’s SDNY Chapter, and is currently on the FBA’s national Board of Directors. During his term as founding Chair of the Dispute Resolution Section of the New York State Bar Association the former ADR Committee of 93 members grew to be an 800 member section, rising two years later to 3,000 members. He has also served on ADR Advisory Groups to the New York Court system and trained their Commercial Division mediators for the last 18 years. He was selected for New York Magazine’s 2005–2014 “Best Lawyers” and “New York Super Lawyers” listings for ADR, and as the Best Lawyers’ “Lawyer of the Year” for ADR in New York for 2011 and 2014. He teaches on the ADR faculty at Benjamin N. Cardozo School of Law and is a frequent speaker and trainer on ADR.
